Waiver of Liability

As a condition of using the amenities provided at the rental property located at 19008 N 71st Lane, Glendale, AZ 85308, I/we, the undersigned, hereby acknowledge and agree to the following terms and conditions on behalf of myself and all additional guests:

1. Swim at Own Risk: I/we understand that the use of the pool, hot tub, and fish pond is at our own risk. There are no lifeguards on duty, and the property owner shall not be held liable for any accidents, injuries, or deaths that may occur while using these facilities. There is no diving permitted and no running on the deck surfaces. 
2. Bicycles: I/we acknowledge that the use of bicycles that may be provided by the property is at our own risk. I/we agree to wear appropriate safety gear, including helmets, and understand that the property owner shall not be held liable for any accidents, injuries, or deaths that may occur while using the bicycles.
3. Assumption of Risk: I/we acknowledge that activities involving the pool, hot tub, bicycles, and fish pond involve inherent risks, including the risk of serious injury or death. I/we voluntarily assume all risks associated with these activities.
4. Hold Harmless: I/we agree to indemnify and hold harmless the property owner, their agents, employees, and representatives from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of or in connection with my/our use of the pool, hot tub, bicycles, and fish pond.
5. Compliance with Rules: I/we agree to comply with all posted rules and instructions regarding the use of the pool, hot tub, bicycles, and fish pond. Failure to comply may result in the immediate termination of our stay without a refund.
6. Responsibility for Minors: I/we acknowledge that it is our responsibility to supervise any minors in our party while using the pool, hot tub, bicycles, and fish pond.
7. Bunk beds: I/we acknowledge the risks associated with using bunk beds and acknowledge that it is our responsibility to supervise any minors in our party while using the bunk beds.
8. I/we acknowledge that this property is privately owned and the owners are not responsible for accidents, injuries, or illness that occurs while on the premises or its facilities. The owners are not responsible for the loss of belongings or valuables of the guest. By booking this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
